1. Acceptance of Terms

By accessing and using FunLand Adventure Park's facilities, services, and website, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use our services or visit our facilities.

These Terms of Service apply to all visitors, users, and others who access or use our services, including but not limited to park visitors, website users, event participants, and service recipients.

2. Use of Services

FunLand Adventure Park provides family entertainment services including but not limited to:

• Amusement park rides and attractions
• Interactive games and entertainment
• Birthday party hosting and event services
• Educational programs and activities
• Food and beverage services
• Retail merchandise

All services are provided subject to availability and may be modified, suspended, or discontinued at any time without prior notice.

3. Safety Requirements and Restrictions

For the safety and enjoyment of all guests, the following requirements must be observed:

• Age and Height Restrictions: Certain attractions have minimum age or height requirements for safety reasons.
• Health Restrictions: Guests with certain medical conditions may be restricted from participating in certain activities.
• Supervision Requirements: Children under 12 must be accompanied by an adult at all times.
• Dress Code: Appropriate attire including closed-toe shoes is required for safety.
• Behavioral Standards: All guests must conduct themselves in a respectful and safe manner.

Failure to comply with safety requirements may result in removal from the premises without refund.

4. Admission and Pricing

Admission fees and pricing for services are subject to change without notice. Current pricing is available at our facility and on our website. All sales are final unless otherwise specified.

Refund Policy:

• Admission fees are non-refundable except in cases of facility closure due to weather or technical issues
• Birthday party and event bookings may be rescheduled with 48 hours advance notice
• Merchandise purchases may be returned within 30 days with receipt
• Food and beverage purchases are final sale

5. Liability and Risk Assumption

Participation in activities at FunLand Adventure Park involves inherent risks. By using our services, you acknowledge and assume these risks. FunLand Adventure Park, its employees, and affiliates shall not be liable for:

• Personal injury or property damage resulting from your use of our facilities
• Loss or theft of personal belongings
• Indirect, incidental, or consequential damages
• Damages resulting from failure to follow safety instructions or posted rules

Our liability is limited to the maximum extent permitted by Canadian law. We strongly recommend purchasing appropriate insurance coverage.

6. Photography and Media Release

By entering FunLand Adventure Park, you grant us the right to photograph, film, and record you and your party for promotional and marketing purposes. These images may be used in:

• Website and social media content
• Advertising and marketing materials
• Promotional videos and publications
• News and media coverage

If you do not wish to be photographed or filmed, please inform our staff upon arrival.

7. Prohibited Conduct

The following conduct is strictly prohibited at FunLand Adventure Park:

• Violent, threatening, or disruptive behavior
• Use of alcohol, drugs, or controlled substances
• Bringing outside food, beverages, or unauthorized items
• Smoking or vaping anywhere on the premises
• Unauthorized commercial photography or filming
• Damage to park property or equipment
• Harassment of other guests or staff members

Violation of these rules may result in immediate removal and potential legal action.

8. Website and Digital Services

Our website and digital services are provided "as is" without warranty. We reserve the right to:

• Modify or discontinue any aspect of our digital services
• Monitor and record communications for quality assurance
• Block access from users who violate these terms
• Update content, pricing, and information without notice

Users are responsible for maintaining the security of their account information and for all activities under their account.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

By using our services, you consent to the collection and use of information as outlined in our Privacy Policy. We comply with Canadian privacy legislation including PIPEDA (Personal Information Protection and Electronic Documents Act).

10. Force Majeure

FunLand Adventure Park shall not be liable for any failure or delay in performance under these terms due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, severe weather conditions
• Government regulations or orders
• Public health emergencies
• Equipment failures or technical difficulties
• Labor disputes or strikes

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved in the courts of Ontario.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
